01 · Service agreement
Terms of Service
These Terms form a binding agreement between Westland Ltd ("Pazaraya", "we") and the person or business creating or operating a Pazaraya merchant account ("Merchant", "you"). You confirm that you use the service for a trade, business or professional activity and have authority to bind that business.
What Pazaraya provides
Pazaraya provides hosted video storefronts, product and order tools, payment and shipping integrations, communications, analytics, domains and related software. We may improve, replace or discontinue features, with reasonable notice where a material paid feature is affected. We do not guarantee uninterrupted availability, but we use reasonable care to keep the service secure and operational.
Your store and your customers
You are the seller of record for products sold through your store. You set products, prices, taxes, shipping, returns and customer terms; verify that your goods and marketing are lawful; and handle customer support and statutory consumer rights. Pazaraya is not a party to the retail contract between you and your customer. Stripe or another configured provider processes payment services under its own terms.
Plans, renewal and fees
The current plan price, billing interval, product limit and platform transaction fee are shown on the pricing page and again before checkout. Paid subscriptions renew automatically for the selected monthly or annual interval until cancelled through the billing portal. Taxes and third-party processing charges may be added where applicable. A trial or promotion applies only where expressly shown and converts as described at enrolment.
You may cancel at any time; access continues until the end of the paid period unless the service states otherwise. Fees already paid are non-refundable for unused time, except where required by law or where we confirm a billing error. This does not limit mandatory rights.
Failed or unpaid subscriptions
If payment fails, we may retry collection and give a short recovery period. When a paid subscription expires, is cancelled, paused or remains unpaid, the store is downgraded to the current Free plan: the custom domain is disconnected from Pazaraya, Free-plan limits, branding and transaction fees apply, and products above the active limit may be hidden or made inactive. We do not immediately delete the store. We may suspend access or delete data after notice if the account remains inactive or unpaid, subject to the retention rules below.
Accounts, content and security
You must provide accurate information, protect account credentials and promptly tell us about unauthorised access. You retain ownership of your content and grant Pazaraya a worldwide, non-exclusive licence to host, copy, transform, display and transmit it only as needed to operate, secure and promote the service and your storefront. You must have all rights required for uploaded videos, images, trademarks and customer data.
Suspension and termination
We may restrict content, payments, a store or an account where reasonably necessary for security, legal compliance, unpaid fees, serious or repeated policy breaches, fraud or harm to users. Where appropriate, we provide the reason and an opportunity to appeal. You may close your account by contacting us. Terms that by nature survive termination — including payment, liability, intellectual property, data retention and dispute provisions — remain effective.
Liability
To the maximum extent permitted by law, neither party is liable for indirect or consequential loss, loss of profit, revenue, goodwill or data. Pazaraya's aggregate liability arising from the service is limited to the fees you paid to Pazaraya during the 12 months before the event giving rise to the claim. This limitation does not apply where liability cannot legally be excluded, including fraud, wilful misconduct, death or personal injury caused by negligence.
Law and changes
Bulgarian law governs these Terms, excluding conflict-of-law rules. The competent courts in Sofia, Bulgaria have jurisdiction, subject to mandatory law. We may update these Terms for legal, security or service changes. Material changes will be announced in the service or by email before they take effect.
02 · Personal data
Privacy Notice
Westland Ltd is the controller for merchant accounts, subscriptions, platform support, affiliate accounts, service security and Pazaraya's own website analytics. For personal data a Merchant collects from storefront customers — such as orders, returns and customer conversations — the Merchant is normally the controller and Westland Ltd acts as processor under the Data Processing Terms below.
Data we collect
- Account and identity data: name, email, authentication details, business and store information.
- Billing and commercial data: plan, invoices, subscription status, Stripe identifiers, platform fees, affiliate balances and payout information. We do not store complete card numbers.
- Store and customer-operation data: products, media, orders, delivery details, returns, messages, attachments and support tickets.
- Technical data: IP address, device/browser information, session, consent, security and diagnostic logs.
- Usage and analytics data when you allow optional analytics.
Purposes and legal bases
- Performing the contract: creating accounts, hosting stores, billing, support and requested integrations.
- Legitimate interests: securing the platform, preventing abuse, improving reliability, measuring service performance and communicating about the account, balanced against your rights.
- Legal obligations: accounting, tax, fraud prevention, sanctions and lawful authority requests.
- Consent: optional analytics, advertising technologies and marketing communications where consent is required. Consent may be withdrawn at any time.
Sharing and international transfers
We share data only with service providers needed to operate Pazaraya, authorities where legally required, professional advisers under confidentiality, or a successor in a corporate transaction. Providers may process data outside the EEA/UK. Where required, we rely on adequacy decisions, Standard Contractual Clauses or another lawful transfer mechanism.
Retention schedule
- Merchant account and store configuration: while active, then normally 30 days after deletion or final termination; residual encrypted backups may remain for up to 90 days.
- Orders, payments, refunds, invoices and accounting/tax evidence: 10 years where Bulgarian accounting law requires it.
- Platform support tickets and account communications: 24 months after closure.
- Storefront customer messages: under the Merchant's instructions while the store is active, normally no longer than 24 months after the last activity unless the Merchant deletes them sooner or law requires longer retention.
- Security and abuse logs: normally up to 12 months; analytics data: normally up to 25 months.
- Affiliate commission and payout records: up to 10 years where they form accounting or tax evidence.
Specific records may be kept longer for a legal claim, investigation, chargeback or statutory duty and then isolated from ordinary use.
Your rights
Depending on applicable law, you may request access, correction, deletion, restriction, portability or objection; withdraw consent; and complain to the Bulgarian Commission for Personal Data Protection or your local supervisory authority. Some US state laws may also provide access, correction, deletion and opt-out rights. Pazaraya does not sell personal information. Use info@pazaraya.com and tell us which account or store is involved. We may verify identity before acting.
For a request about a purchase from a Merchant, contact that Merchant first because it controls the order data. We will assist the Merchant where required.
03 · Device storage
Cookie Notice
Pazaraya uses cookies and similar browser storage. Essential technologies support authentication, security, checkout continuity, the shopping bag, interface preferences and your consent choice. They do not require optional consent where the law permits.

Analytics and marketing tools remain off until you choose. "Necessary only" is as easy to select as "Allow all", and no optional box is preselected. Storefronts may use separate preferences because each Merchant chooses its own analytics and pixels.
04 · Merchant customer data
Data Processing Terms
This section is incorporated into the Terms and is intended to meet Article 28 GDPR requirements. It applies when Westland Ltd processes personal data on a Merchant's behalf.
Scope
The subject matter is hosting and operating the Merchant's storefront, products, orders, returns, customer inbox, attachments, email and related commerce tools for the duration of the account. Data subjects may include customers, prospective customers, recipients, staff and support correspondents. Data may include identity, contact, order, delivery, communications, device and transaction-reference data; full payment-card data is processed by the payment provider.
Our commitments
- Process personal data only on documented instructions, including these Terms and configured features, unless law requires otherwise.
- Ensure authorised personnel are bound by confidentiality and apply appropriate technical and organisational security measures.
- Use subprocessors under written protections, remain responsible for their processing and give notice of material changes so a Merchant may raise a reasoned objection.
- Assist with data-subject requests, security, breach assessment, impact assessments and regulator consultations, considering the nature of processing.
- Notify the Merchant without undue delay after becoming aware of a personal-data breach affecting its customer data.
- On termination, delete or return personal data according to the retention schedule, unless law requires storage.
- Provide information reasonably necessary to demonstrate compliance and support proportionate audits, subject to confidentiality and security limits.
The Merchant must provide lawful instructions, an appropriate privacy notice, a legal basis for processing and only collect data needed for its business. The Merchant authorises the providers listed below as subprocessors.
05 · Platform safety
Acceptable Use Policy
You may not use Pazaraya for unlawful, fraudulent, deceptive or harmful activity. Prohibited content, products and conduct include:
- illegal, stolen, counterfeit or intellectual-property-infringing goods;
- controlled drugs, unlawfully supplied medicines, weapons, explosives or recalled/unsafe products;
- child sexual abuse material, sexual exploitation, trafficking, terrorist content or unlawful hate content;
- fraud, phishing, malware, impersonation, misleading claims or manipulation of reviews and metrics;
- unlicensed gambling, financial, medical or other regulated services, and age-restricted goods without required controls;
- privacy violations, doxxing, unlawful surveillance, spam or use of personal data without a valid legal basis;
- sanctions evasion, prohibited cross-border trade, or activity that creates a material risk to users, Pazaraya or its providers.
Merchants are responsible for licences, age verification, product safety, consumer information and market-specific restrictions. We may investigate, preserve evidence, restrict content or accounts, and cooperate with lawful authorities.
06 · Notice and action
Report illegal content
Anyone may report content believed to be illegal in the EU by emailing info@pazaraya.com. To help us act, include the exact storefront/product URL, a clear explanation of why the content is illegal, relevant evidence or law, your name and email, and a good-faith statement that the information is accurate.
We acknowledge complete notices, assess them promptly and communicate the outcome where possible. Affected Merchants normally receive a reason for a restriction and may appeal by replying to the decision. Emergency threats should also be reported to the appropriate authority. This channel is not a substitute for police or court procedures.

Providers may change as the platform develops. We will keep this list current and notify Merchants before a material new subprocessor handles Merchant customer data where required.
